The Simpsons is one of my favorite shows of all time. And this is one of the best episodes. Chester J. Lampwick claims he invented Itchy & Scratchy (and the whole concept of cartoon violence). With the help of Bart and Lisa, he files suit against Itchy & Scratchy Studios and Roger Meyers Jr., the head of the studio. Obviously, they hire Lionel Hutz to litigate....

I get asked a lot about whether being a practicing attorney is like being a lawyer on TV. I love watching legal movies and courtroom dramas. It's one of the reasons I decided to become a lawyer. But sometimes they make me want to pull my hair out because they are ridiculous.
Today I'm taking a break from representing clients and teaching law students how to kick ass in law school to take on lawyers in the movies and on TV. While all legal movies and shows take dramatic license to make things more interesting (nobody wants to see hundreds of hours of brief writing), many of them have a grain of truth.

  • Objection! 15:54 That’s not entirely accurate. A few years ago there was an attempt by the Agatha Christie estate to publish a new Poirot novel simply to keep the character out of public domain, and a few years before that Harper Lee published a sequel to “To Kill a Mockingbird” because that book was entering public domain. See, works featuring a character can be eligible but cannot be featured in new media until the character themselves enters, which isn’t until all registered works featuring that character are eligible. This is also why Murder on the Orient Express and Death on the Nile got remade, and why there’s nine Hellraiser sequels- copyright retention. The other reason copyright law keeps getting more archaic is Disney. The Copyright Act is pejoratively referred to as the Mickey Mouse Act because so much of the lobbying around it is by Disney’s near mythic legal department. There’s an entire team whose sole purpose is to ensure Mickey Mouse and related characters never enter public domain.

  • OBJECTION! While yes, the copyright would be expired by 2020, rendering the copyright issue moot, would there not be a possible argument over trademark? Mascots can be trademarked, and if the creator was indeed threatened with "an anvil dropped on his head", would he not have an argument to the trademark, despite not having filed one, due to feeling threatened out of it?

  • Two thinks you didn't show or bring up. 1) Why is Bart testifying after the defense closing argument? 2) They did authenticate the slide Bart showed i court. Bart took off the back covering and it said "To Roger Myers. Keep drawing. "Your moxie more than makes up for your lack of talent. Your pal, ChesterJ. Lampwick. September 3, 1919 ". Wouldn't that authenticate it? (again ignoring when in the trial it was discovered)

  • This episode is a shot at disney for muscleing the US government into extending copyright protection to 75 years instead of 50. Mickey Mouse was going to enter public domain in 1998. We'll see if Disney decides to change the law again in a few years.

  • "Who is the voice of Chester Lampwick?" Ah, classic Simpsons, when celebrity cameos were written to serve a function of the story, rather than to just exist as obvious cameos. It never even occurred to me that Chester was voiced by a celebrity, even after all these years. I didn't recognize his voice, so I just assumed it was one of the regular voice actors. A lot of these similar cameos I've missed over the years, and DEFINITELY upon initial viewing as a child.

  • Objection! Chester and Grandpa would have to show an intention to create legal relations between them when exchanging corn muffins for painting the chicken coop. It appears they are friends. The presumption (in English common law anyway) is friends generally do not have this intention so while there appears to be a good offer and acceptance plus consideration, Grandpa's claim seems to fall over.

  • This episode was inspired by the controversy involving Oswald The Rabbit and the Universal Studios lawsuit over the creation of Mickey Mouse. Funny enough though it was actually Disney's Oswald that was the character which was legally stolen from him and Universal were subsequently suing him because they perceived his new character of Mickey Mouse to be far too similar to Oswald. Disney learnt he needed to protect himself legally and that was when he decided to found the Walt Disney Company and Walt Disney Pictures. So the story is correct, but it was Disney that was actually robbed of a character and nearly had Mickey Mouse robbed from him too.

  • This episode also lightly pokes fun at the Walt Disney vs Ub Iwerks case. Iwerks designed the studio's first character Oswald the Lucky Rabbit and all the early Mickey Mouse characters including Minnie, Pete and Mortimer (Mickey's rival).

  • The Simpsons writers weren't paid enough in the 90s. One of the best series ever. I'd rather watch an episode from the 90s I've seen 6 times rather than an episode from late 00s onwards. For example, that episode where they went to Australia was hilarious. As an Australian and knowing most of those stereotypes were greatly exaggerated I still lmao at it.
